ARLINGTON CONSERVATION COMMISSION
MINUTES
NOVEMBER 27, 2001
Mr. Stevens called the meeting to order at 7:00pm in the second floor conference room of the Town Hall Annex. Present were Nathaniel Stevens, Timothy Sullivan, Judith Hodges, David White, and Christine Wallace of the Commission.
7:00 MUGAR PARCEL –
The Commission received the Superseding Order of Resource Area Delineation decision by DEP issued November 14, 2001 setting the 100-year floodplain line at an elevation of 8.1 feet as requested by the applicant. This in effect overrides the Conservation Commission’s decision.
A brief discussion was held on the procedures that an appeal by the Commission would have. The appeal would ask for an adjudicatory hearing by an administrative law judge to reconsider the DEP staff person’s decision. Immediately after filing for the appeal, we would file for a stay until the court case regarding the local bylaw has been concluded in Middlesex Superior Court. Our attorneys, Nancy Kaplan and Cheryl Blaine would file the appeal and stay on behalf of the Commission.
White/Hodges motioned to appeal the DEP’s decision setting the 100-year floodplain elevation at 8.1 feet; motion passed unanimously.
The Commission will draft a news release of these developments.
The Commission voted to convene at approximately 7:30pm.
