ARLINGTON CONSERVATION COMMISSION
MINUTES
SEPTEMBER 4, 2003
Mr. Stevens called the meeting to order at 7:30pm in the second floor conference room of the Town Hall Annex. Present were Nathaniel Stevens, David White, Timothy Sullivan, Catherine Garnett, Christine Wallace and Judith Hodges.
7:30pm MISCELLANEOUS –
Fiscal: White/Sullivan motioned to pay Aquatic Control Technology $790 for hand-removal of water chestnuts from the Arlington Reservoir this past August; motion passed unanimously.
Mr. White presented a letter of application for a DEM trail grant at Arlington’s Great Meadows in Lexington. The proposal is to build board walk paths through the wetland approximately 600 feet long. The materials will cost approximately $8000. Sullivan/Garnett motioned to support this grant application; motion passed unanimously.
The Commission discussed the need for a policy of the application of herbicides on Conservation Lands. Some land Stewards have asked to do this and it is illegal for anyone to apply herbicides on any property that they do not own, such as public land.
The Commission reviewed the press release for the new land stewardship fund. The new name will be the “ACC Stewardship Fund”. The press release will be distributed at the Town Day booth.
Mr. Stevens suggested drafting a policy for applications that wish to utilize the warrant article variance for floodplain mitigation. Wallace/Hodges motioned to approve a bylaw regulation revision that stipulated an application for this waiver must be a written notification specifying how the project meets the standards of the variance and why the waiver is necessary; motion passed unanimously.
Mr. Stevens submitted a photo of the shoreline Upper Mystic Lake at 339 Mystic St. The embankment is cleared of vegetation. Hodges/White motioned to issue an Enforcement Order to 339 Mystic St., in violation of their existing permit (DEP File No.91-156), to issue fines of $300 per day from the date the violation occurred until they come into compliance and file a replanting plan; motion passed unanimously.
Since the photograph also showed clearing at the adjacent property, White/Garnett motioned to issue a Notice of Violation letter to 335 Mystic St, also requiring a replanting plan; motion passed unanimously.
The Commission voted to convene at approximately 9:45pm.
