ARLINGTON CONSERVATION COMMISSION
MINUTES

SEPTEMBER 18, 2003

Mr. Stevens called the meeting to order at 7:30pm in the second floor conference room of the Town Hall Annex.  Present were Nathaniel Stevens, David White, Timothy Sullivan, and Judith Hodges of the Commission.  Christine Wallace and Catherine Garnett were absent (due to work conflicts).  Ellen Reed, who has applied to join the Commission, was also present.    Julia Young and Bruce Fitzsimmons were present for the 90-92 Fairmont Street project.  Heather and Brian Sullivan were present for the 43 Dothan St project.  Louise and Richard Piazza were present for 335 Mystic St.   Others present were: Anne Rameid, Cathleen  and Donald Ifetter, Dennis Kelleher, Brigid Pfister.

7:30pm  -

7:45pm – 90-92 FAIRMONT ST – NOTICE OF INTENT for extension of driveway  

Attorney Fitzsimmons presented the proposal to pave more driveway in the outer Riverfront Area.  The proposal is for 120 square feet more paving.  The Commission required that this paving be porous pavers.  

Ms. Young asked if she could prune the trees on her lot.  The Commission responded that up to 20% of limbs on a tree may be done according to the Bylaw Regulations.  

Sullivan/White motioned to approve the project with the condition to use porous paving; motion passed unanimously.

8pm - 339 MYSTIC ST - ENFORCEMENT for clearing of vegetation within the Bufferzone to Mystic Lake, in violation of DEP File No.91-156

Ms. Beckwith updated the Commission that she had received voicemail from a relative of the homeowner at 339 Mystic but that she had not spoken with them in person.  The Commission directed her to tell them to come to the October 2 meeting.  In addition, White/Hodges motioned to authorize Town Counsel to start legal proceedings; motion passed three votes to one.  Mr. Sullivan voted against the motion

8:15pm – 43 DOTHAN ST – working session for paving of entry road

The Sullivans were present to discuss the permit they plan to file with the Commission now that Town Meeting has approved the waiver provision of the wetlands Bylaw.

8:30pm – 335 MYSTIC ST – ENFORCEMENT for clearing of vegetation within the Buffer Zone to Mystic Lake, no existing permit.

Mr. White and Ms. Beckwith presented photos to the Commission of a site walk held on September 17, 2003.  There were stumps of Staghorn Sumac and Japanese Knotweed still on the slope as well as debris from sewer line work and a crumbling access path of cinderblocks.  They said that they did not cut any trees.  No large stumps were present.  Mr. and Mrs. Piazza explained that they had cut the vegetation in order to remove poison ivy and what they thought was poison sumac.

The Commission explained further what they would like to see in a planting plan with specified tree species and a reconstruction of the path to the water.
 
The Commission voted to convene at approximately 9:45pm.
