ARLINGTON CONSERVATION COMMISSION
MINUTES
OCTOBER 7, 2004
Mr. Stevens called the meeting to order at 7:30 p.m. in the second floor conference room of the Town Hall Annex. Present were Timothy Sullivan, David White, Judith Hodges, Nathaniel Stevens, Ellen Reed and William O’Rourke of the Commission. Catherine Garnett of the Commission was absent. Also present were Jeffery Stern of 93 Sunnyside Ave., Mark Mitsch, Clarissa Rowe and John Sanchez, Director, Department of Public Works, regarding the Arlington Reservoir Dam Rehabilitation project.
7:30 p.m. - COMMISSION BUSINESS
The Commission will consider the implementation of a Conservation Restriction at Symmes, and was in agreement with the division of managing such a CR as suggested by Brian Rehrig of the Arlington Land Trust.
Enforcements
33 Ryder St - Ms. Beckwith, Mr. White and Mr. Stevens of the Commission will conduct a site walk of Lalicata Landscaping on October 13, 2004 to confirm compliance with the Wetlands Protection Act and the Arlington Wetlands Bylaw.
7:45pm - 93 SUNNYSIDE AVE – REQUEST FOR DETERMINATION OF APPLICABILITY for reconstruction of an existing house
Mr. Stern explained the circumstances that lead to the remediation work that occurred at his house, involving the accidental delivery of home heating oil to his house when he uses natural gas. The work included the removal of the basement floor and some soil removal, necessitating the reconstruction of the rear portion of the house. Mr. Stern will replace the asphalt driveway with a gravel one. The footprint of the building will not change from the previous footprint.
Sullivan/O’Rourke motioned that while the work is within a jurisdictional resource area, Riverfront, Buffer Zone and potentially a portion of the lot is within floodplain, that the work will not impact those resources and that the filing of a Notice of Intent is not required; motion passed unanimously.
8:15pm – ARLINGTON RESERVOIR DAM REHABILITATION (DEP File No. 91-171) – working session
Mr. Mitsch explained the need for a tree survey to be conducted soon for the proposed spillway area and that the wetland replication site needed to be approved. The Commission agreed to participate in the tree count and to view potential replication sites in the near future. The Commission clarified that each tree need not be surveyed and put on a plan. A more general idea of the location is needed, plus a table of the species, size and number of trees that will be removed.
The Commission voted to convene at approximately 10 p.m.
