BOARD OF HEALTH MEETING MINUTES

Wednesday, December 12, 2001

3:30 p.m., Fox Community Center

Board Members in Attendance: Dr. Carole Allen (Chair), Mr. Gregory Leonardos, Mr. Mark Fingerle
Staff in Attendance: Denise Hunt Boucher (Health Compliance Officer), Marie Walsh (Director of Public Health)

I.      Minutes of October 17, 2001 meeting accepted as written.

II.     Marie Walsh reported that the Massage Therapy Regulations Review Committee has convened and is in the process of reviewing and comparing regulations from other municipalities.  Two members of the committee gave presentations: Linda Guttman of Body & Soul Massage Therapy presented information on Massage Therapy and La Stone Therapy; Patricia Carusone of Charles River School of Shiatsu presented information on Shiatsu and Oriental Bodywork.
 
III.    Ms. Walsh introduced Denise Hunt Boucher as the new Health Compliance Officer for the Tobacco Control Program.  Ms. Boucher has several years experience working for MTCP funded programs including a position at Advocates, a social services agency in Framingham, and a position as the Director of the Billerica/Tewksbury Tobacco Control Program.

IV.     Hearing Request: Stephania Iamandei, owner of 70 Lancaster Road, requested a hearing regarding the inspection performed on October 3, 2001.  Ms. Iamandei stated that a notice to quit was served to the tenants on April 5, 2001 and that rent has not been paid since July 2001.  She presented a copy of a judgment from Middlesex County Court ordering tenants to vacate the unit as of December 10, 2001.  The Board voted unanimously to order correction of violations as soon as tenants vacate the unit.

V.      Hearing Request:  An inspection of 84 Webcowett Road was performed on September 19, 2001 and a re-inspection was performed on October 23, 2001.  Mr. Manual Vaz Morias, proptery owner, appeared and stated that violations were not corrected due to difficulties between him and the tenant which resulted in court hearings; the tenant has since vacated the unit.  Mr. Morias requested a variance from 105 CMR 410.553 to allow bay windows in the living room to remain without screens.  Ms. Walsh reported that there are other screened windows in the room to provide ventilation.  The Board voted unanimously to grant the variance and require that all other violations be corrected prior to the next tenants occupancy.

VI.     Shelia Dietchman, Ann Elitisio, and Delores Hajjar of 17 Old Colony Lane appeared to report an odor complaint in their building that they believe is caused by one unit owner.  Ms. Walsh stated that an investigation of the odor is being conducted.
