To the Constables of the Town of Arlington, in said County:

GREETINGS:
In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Arlington to meet in the

TOWN HALL
in said Town on

MONDAY
THE FIRST OF OCTOBER 2001

At 8 o’clock P.M., at which time and place the following articles are to be acted upon and determined exclusively by Town Meeting Members, in accordance with, and subject to, the referenda provided by Chapter43A of the General Laws.

ARTICLE 1       REPORTS OF COMMITTEES
To receive, hear, and act upon the reports of the Board of Selectmen, Finance Committee, Redevelopment Board, and other committees, commissions, and boards heretofore appointed, including, without limitation: Permanent Town Building Committee (April 23, 1969), Vision 2020 Standing Committee (June 8, 1992), School Facilities “Working Group” (May 4, 1994), ByLaw Recodification Study Committee (May 9, 1994), Millennium Celebration Committee (May 21, 1997), Telecommunications Committee (June 18, 1997), Noise Abatement Study Committee (May 11, 1998), Affordable Housing Task Force (May 3, 1999), Zoning Bylaw Review Committee (May 12, 1999), Uncle Sam Committee (May 17, 1999), Fields and Playgrounds Task Force (May 19, 1999), Maintenance Study Committee (May 1, 2000), and Alewife Brook Advisory Committee (May 15, 2000), Newsracks Study Committee (May 9, 2001), Community Preservation Act Study Committee (May 21, 2001), and Symmes Hospital Advisory Committee (May 21, 2001), or take any action related thereto.

ARTICLE 2       LAND ACQUISITION/SYMMES HOSPITAL
To see if the Town will vote to take any or all of the following actions:
1.      To purchase, lease, or take by eminent domain, or otherwise acquire that property in the Town currently owned by Lahey Clinic and HealthSouth, that being the site of the medical facility previously referred to as Symmes Hospital, and any or all of its adjacent land;
2.      To authorize the appropriate Town Boards and officials to enter into development plans for the site, including the renting of certain portions thereof;
3.      To determine the jurisdiction of the site;
4.      To authorize the expenditure of funds for maintenance and necessary capital improvements but not major renovations as the latter were authorized by the May 5, 2001 debt exclusion vote since same will be dealt with at a future Town Meeting;
5.      To authorize the hiring of consultants or the engaging of development partners;
6.      To authorize land swaps with private developers;
7.      To authorize the conveyance or sale of the property to an independent town authority or to take advantage of the provisions of M.G.L. Chapter 121A and/or 121B and by doing all things necessary to designate the property for recognition under said chapters; by giving jurisdiction thereof to the Arlington Redevelopment Board and providing the authority to the Arlington Redevelopment Board to take the property by eminent domain or otherwise acquire it;
8.      To provide for a vehicle for amortizing the bond issue from the proceeds of any revenue generated by the development including a system of reducing the tax rate so as to repay taxpayers for amounts paid from bond issues outside the normal Proposition 2½ tax levy limit;
9.       To designate certain of the property as open space;
10.     To amend the vote under Article 77 of the 2001 Annual Town Meeting establishing the Symmes Advisory Committee;
11.     To file Home Rule legislation to accomplish any or all of the foregoing;
12.     To appropriate a sum of money to accomplish any or all of the foregoing; to determine how the money will be raised and expended including the possibility of borrowing all or any portion thereof;
or take any action related thereto.

ARTICLE 3       ACCEPTANCE OF LEGISLATION/
COMMUNITY PRESERVATION ACT
To see if the Town will vote to accept the provisions of M.G.L. Chapter 44B, sections 3 through 7, the Community Preservation Act, to do all things necessary and appropriate under this act, including without limitation determining the contents of a specific proposal to be presented to the voters of the Town, or take any action related thereto.

ARTICLE 4       ARLINGTON HOUSING AUTHORITY/
LOW INCOME HOUSING PROJECTS
To see if the Town will vote to authorize pursuant to the provisions of Section 39 of Chapter 121B so as to enable the Housing Authority to provide housing for elderly and handicapped persons of low income, or accept or act under any other relevant statutory provision that expands the capability of the Housing Authority to provide affordable housing; or take any action related thereto.

ARTICLE 5       APPROPRIATION/TRANSFER OF FUNDS
HARDY SCHOOL PLAYGROUND
To see if the Town will vote, pursuant to the provisions of Chapter 44 of the Acts of 1998 entitled:  “An Act Authorizing the Town Manager in the Town of Arlington to Lease Certain Park Land and Other Open Spaces to Wireless Communications Companies for the Erection of Wireless Antennas or Other Related Appurtenant Structures”; to appropriate from the account established under Section 2 thereof, funds to defer the expense of certain improvements to the Hardy School playground or neighborhood park or other purposes, to further transfer any monies not needed for the Hardy School playground or neighborhood park to the capital budget, or for such other purposes consistent with the provisions of said Chapter 44, or take any action related thereto.
