ARTICLE 23                        HOME RULE LEGISLATION/DANIEL WESINGER

VOTED:  (STANDING VOTE – 120 IN THE AFFIRMATIVE AND 2 IN THE NEGATIVE)

That the Town does hereby request and authorize the Board of Selectmen to file Home Rule Legislation to provide as follows:

“AN ACT TO PERMIT TOWN RESIDENT, DANIEL WESINGER TO TAKE THE CIVIL SERVICE TEST FOR THE POSITION OF FIREFIGHTER IN THE TOWN OF ARLINGTON.

Section 1       Notwithstanding the provisions of any special or general law to the contrary including without limitation Chapter 31 of the General Laws, the Civil Service Law, Daniel Wesinger, a resident of the Town of Arlington is authorized to take the Civil Service examination and is eligible for appointment to the position of Firefighter notwithstanding the fact that he has attained the age of 32, provided however that such exemption shall expire on
December 31, 2012.

Section 2       This Act will take effect upon its passage”

ARTICLE 52                              APPROPRIATION/SCHOOLS FACILITIES WORKING GROUP

VOTED:  (UNANIMOUSLY)   (QUORUM PRESENT)

That the Town Meeting supports the prime recommendation of the School Facilities Working Group which includes the following actions:

(1)     Letters of interest for the Thompson and Stratton Elementary Schools be submitted to the Massachusetts School Building Authority (MSBA) prior to June 30, 2007.
(2)     That since it is likely that it will be 3 to 5 years until the MSBA provides funding for the Thompson School that such amounts of monies be spent on the school to ensure that the facility meets the basic needs of the students and faculty using the facility.  This includes $120,000 in the Capital Budget for fiscal 2008,
(3)     That since it is likely that it will be 15 to 20 years until the MSBA provides funding for the Stratton School that the Town appropriate approximately $150,000 per year over the next 10 years in the Capital Budget to upgrade the facility over that period.
(4)     That the School Facilities Working Group shall continue to discharge its duties, as laid out in the unanimous vote of the 2006 Annual Town Meeting under its Article 65, fully and completely, including, but not limited to, revising plans and reporting to the Thompson and Stratton communities, and to Town Meeting, annually until construction has commenced on the seventh elementary school.

It is further voted that the School Facilities Working Group’s membership shall be redefined as:  the Superintendent, the Town Treasurer, the Town Manager or his/her designee, the Director of Planning or his/her designee, the chair of the Permanent Town Building Committee or his/her designee, the chair of the School Committee or his/her designee, the chair of the Board of Selectmen or his/her designee, the chair of the Finance Committee or his/her designee, the chair of the Capital Planning Committee or his/her designee, and Town Meeting Members representing the Thompson and Stratton school districts (said Town Meeting Members to be appointed by the Moderator).

ARTICLE 53      APPROPRIATION/FINANCING OF CONSTRUCTION OR RECONSRUCTION OF SEWERS AND SEWERAGE FACILITIES

That the sum of $407,000 to be used with a grant of $333,000, be hereby appropriated for the purpose of financing the construction or reconstruction of sewers and sewerage facilities, inflow/infiltration reduction or system rehabilitation, including costs incidental and related thereto; that to raise this appropriation the Treasurer, with the approval of the Board of Selectmen, is authorized to borrow $407,000 under and pursuant to Chapter 44, Section 7, of the General Laws, as amended, or any other enabling authority and to issue bonds or notes of the Town therefore; and that the Board of Selectmen and the Town Manager be and hereby are authorized to enter into any agreements they determine to be necessary in connection with the project and its financing and are further authorized to accept and expend in addition to the foregoing appropriation any grants that may be come available therefore from the Massachusetts Water Resources Authority or otherwise.

ARTICLE 55                                  ESTABLISH COMMITTEE/LIBERTY RIDE

The Town hereby establishes a committee to be known as the “Liberty Ride Study Committee,” comprised of five members two to be appointed by the Board of Selectmen, two by the Historical Commission, and one by the Arlington Chamber of Commerce.  The charge of the Committee is to explore the feasibility and benefits of the Town joining the Liberty Ride, which is a fee-based bus service that presently shuttles tourists between historical sites in Concord and Lexington.  The Committee would determine the requirements of joining the Liberty Ride including the cost thereof.  The Committee will report its findings to the Board of Selectmen and the 2008 Annual Town Meeting.

ARTICLE 57                      APPROPRIATION/TRANSFER OF RETIREE HEALTHCARE FUNDS

That the Town takes the following actions:

(a)     that there is hereby established an Other Post-Employment Benefits Stabilization Fund to be managed by the Town Treasurer;

(b)     transfer into said fund all monies currently retained in the fund established under the provisions of Chapter 12 of the Acts of 1998;

(c)     appropriate into said fund the sum of $310,223 representing that amount of money that is the difference between the previously established base amount of $500,000 and the fiscal 2008 appropriation for the non-contributory pension obligation; said sum to be raised by the general tax;

(d)     transfer into said fund the amount of $343,363 received during FY 2007 as Medicare Part D reimbursement and;

(e)     appropriates into said the sum of $155,000 representing the increased share of retiree HMO contributions as voted by the Board of Selectmen on November 6, 2006; said sum to be raised by the general tax.

ARTICLE 70                              ADJUDICATORY HEARINGS

That the Town hereby adopts Section 23D of Chapter 39 of the General Laws which provides as follows:

“(a)    Notwithstanding any general or special law to the contrary, a member of any municipal board, committee or commission when holding an adjudicatory hearing shall not be disqualified from voting in the matter solely due to that member’s absence from no more than a single session of the hearing at which testimony or other evidence is received.  Before any such vote, the member shall certify in writing that he has examined all evidence received at the missed session, which evidence shall include an audio or video recording of the missed session or a transcript thereof.  The written certification shall be part of the record of the hearing.  Nothing in this section shall change, replace, negate or other supersede applicable quorum requirements.
                (b)     By ordinance or bylaw, a city or town may adopt minimum additional requirements for attendance at scheduled board, committee, and commission hearings under this section.

        The acceptance of this section shall apply to the Redevelopment Board, Zoning Board of Appeals, Conservation Commission, Historical Commission and the Historic District Commissions.”

That the motion of the Board of Selectmen be amended as follows:

(a)     By striking out the last sentence thereof and substituting therefore that Title I General Government of the Bylaws be and hereby is amended by providing for a new Article 20 entitled Adjudicatory Hearings which shall provide as follows:


        “The provisions of Section 23D of Chapter 39 shall apply
        to the Redevelopment Board, Zoning Board of Appeals,
        Conservation Commission, and Historic District Commissions.
        The application of said section shall apply only in the event
        that the adjudicatory proceeding before the enumerated
        Boards has more than one session.”

ARTICLE 71                             RESOLUTION/SUSTAINABILITY ACTION PLAN

VOTED:  (QUORUM PRESENT)

WHEREAS, global warming increasingly threatens the world’s health, environment, and economy;

WHEREAS, melting of Arctic and Antarctic ice, the Greenland ice mass, and glaciers around the world is proceeding at a rapid rate;

WHEREAS, the consensus among scientists is that the world must reduce its emissions of greenhouse gases (GHG) by at least 75% in order to eventually stabilize the climate;

WHEREAS, Massachusetts will be increasingly harmed by global warming through changes in our climate, worsening of storms, floods, and droughts, damage to native plant and animal species, rising sea levels, spread of diseases, and losses to our economy;

WHEREAS, the New England Governors and Eastern Canadian Premiers released a Climate Action Plan in 2001 setting goals of reducing GHG emissions to 1990 levels by 2010, to 10% below 1990 levels by 2020, and eventually by 75 to 85% below current levels;

WHEREAS, the Commonwealth of Massachusetts issued its own Climate Action Plan in 2005 committing the Commonwealth to the same goals and laying out a range of policies to achieve the goals;

WHEREAS, actions to reduce emissions of carbon dioxide (CO2) and other GHGs can be taken not only at the national and state levels, but also by local government and households;

WHEREAS, in the year 2000 the Town of Arlington joined the international Cities for Climate Protection campaign through a vote by the Selectmen, committing itself to reducing local emissions of GHGs;

WHEREAS, an inventory done for Arlington in 2000 estimated that total global warming emissions attributable to Arlington’s residents, businesses, Town government and other institutions were the equivalent of 473,540 tons of CO2 in 1997;

WHEREAS, Sustainable Arlington, on behalf of the Town, completed a Climate Action Plan (Arlington Sustainability Action Plan, or ASAP, Part I) that sets goals of reducing our local GHG emissions by 6% in 2010 and 12% in 2015, and lays out a range of actions to achieve these goals;

WHEREAS, the Board of Selectmen has endorsed the ASAP Part I and instructed the Town Manager to participate in its implementation;

THEREFORE,

Arlington Town Meeting hereby votes to adopt the ASAP Part I, and further instructs the Town Manager to place a priority on its implementation, including creation of an Energy Management Task Force for the Town, which shall have the responsibility to maximize energy efficiency within Town operations, to promote efficiency for Town residents and businesses, and to explore possibilities for implementing renewable energy within the Town.

ARTICLE 73                    RESOLUTION/WELFARE AND SAFETY OF CITIZENS

VOTED:  (UNANIMOUSLY)   (QUORUM PRESENT)

“That the Town does hereby adopt the following resolution:

WHEREAS, the Town of Arlington through its elected and appointed officials, has
responsibility for the ongoing welfare and safety of its citizens; and

WHEREAS, these responsibilities include consideration of the impact of an adjacent
community’s actions; and

WHEREAS, the Town of Belmont has approved a proposal to develop an area of adjacent land that will adversely impact Arlington residents; and

WHEREAS, the Arlington Director of Planning and Community Development has submitted to the Town of Belmont testimony that the adverse impact of such a development if it is approved affects Arlington’s citizens.

It is, therefore, resolved that the Town Meeting goes on record as registering its concerns in regard to the Belmont Uplands Project, if said project is approved without consideration by the Town of Belmont and the Project Developer of Arlington’s concerns as set forth in the testimony of the Arlington Director of Planning and Community Development and a letter sent by the Board of Selectmen.  

Such concerns include the severe traffic impact on certain intersections and
streets in the Town of Arlington especially in the vicinity of Lake Street, exacerbated by the lack of any traffic impact study, the dangers imposed to pedestrians and the potential for increased flooding due to inadequate storm water mitigation plans.

ARTICLE 74       RESOLUTION/WAR ON TERRORISM

That the Town does hereby adopt the following resolution:

WHEREAS, the Town of Arlington, Massachusetts has a long and distinguished history of certain residents answering the call to defend freedom; and

WHEREAS, so many Arlington residents have paid the ultimate sacrifice; and

WHEREAS, a number of brave and dedicated Arlington residents should be thanked for dedicating a portion of their lives to the defense of Our Great Nation.

Be it therefore resolved that we, the Town Meeting Members, on behalf of every resident of the Town of Arlington, extend this Statement of Appreciation to the Service Men and Women of the United States Armed Forces and their families, for their sacrifices, including the supreme sacrifice of loss of life.
