Resolution Submitted at 2007 Town Meeting

Resolution: Charging for Useful Life Road Reductions


WHEREAS:        The Town makes large expenditures to keep its streets and roadways in as
good a condition as possible so as to make same safe for vehicular and pedestrian traffic; and

WHEREAS:        Utilities often make cuts in these streets and roadways in order to install
and repair existing utility infrastructure; and

WHEREAS:        It is common knowledge that when such cuts are made the useful life of
the Town’s streets are severely reduced necessitating repair and reconstruction of same; and

WHEREAS:        The Supreme Judicial Court has foreclosed to the Commonwealth’s
municipalities the possibility of charging utilities for this reduction in useful life.

IT IS HEREBY RESOLVED, that the 2007 Arlington Annual Town Meeting requests its state legislative delegation to support House Bill No. 3676, which would supercede the Supreme Judicial Court decision and permit such charges to be made.

Resolution: funding of other post-retirement benefits

WHEREAS:         The local property tax is barely adequate to meet the current obligations of the operating budget of the Town of Arlington,

WHEREAS: It is not possible for the Town of Arlington to generate or capture adequate revenue to fund Other Post-Retirement Benefits,

IT IS RESOLVED: by the 2007 Arlington Town Meeting that Other Post-Employment Benefits obligations should be funded by a revenue mechanism such as a dedicated rider on the state income tax, so that it will be possible to fully fund these future obligations, without increasing the burden on the local property tax; and

IT IS RESOLVED: that the Town of Arlington will follow the recommendations of the Town OPEB Committee as voted by the 2007 Town Meeting to set aside funds for the OPEB obligations.
